A year ago we met with the Lord Advocate and asked her to review Allan’s case. The Crown has now spent a whole year reviewing all of the evidence and this includes new interviews and statements from all the witnesses to the violent restraint of Allan on 24th March 2015.
We as a family have always believed that the investigation into Allan’s death was a sham and was completely mishandled by the police and the Crown from the very beginning. Nearly eight years on, the Lord Advocate now agrees with us.
However, she has also told us it’s not legally possible to prosecute any individual officers for any part they may have played in Allan’s death because they were all given immunity before the Fatal Accident Inquiry. This is extremely disappointing for us, and we say that this gives officers a licence to kill.
The Crown is continuing its investigation and instructed Police Scotland to formally investigate corporate responsibility of the Scottish Prison Service for Allan’s death, including consideration of corporate homicide.
We are grateful that action is now being taken, but it shouldn’t have taken eight years, and it could still lead to a decision not to charge SPS for what happened to Allan. No other person should die like he did and no family should go through what we have.
We will continue to demand justice for the loss of Allan who was a much loved member of our family.
Justice for Allan Marshall 
I too was a one for one transfer to Saughton prison at the end of December 2014 until the 10th January 2015 after being transferred from another prison due to an altercation with a member of staff who punched me in the face during a cell extraction. I had only a few months left to serve and retaliated through fear due to this staff member losing all composure.
So… I was sent to Saughton SRU in a bid to be isolated by management placed in a cell directly opposite their desk with no TV, Radio, no anything in fact!
There directly across they sat there playing the ‘big I am’ as if they were putting on a show for someone else, and like a pack of hyenas in their little gang laughing, dishing dishing out threats, verbal abuse, and how they were “spitting in my dinners” (without declaring who they were of course) nor would they utter a peep while the door was open and I was standing there. But fair play I was after all in their narrow minds, now In their unit to be taken apart for standing upto one of their pals and that’s the cowardly silly childish games they play to try and provoke and antagonise people into situations they can’t get back out of.. I had a few months left in reality who goes and strikes out at staff for no reason? well according to them I did, with absolutely no mention of their wrongdoing of course. Or the fact it is their usual MO (or should I say policy) to accuse those who shatter their fragile egos of false staff assaults when they, in fact have put the boot (or numerous punches and boots) into you. Which was exactly what happened.
On top of all that polaver on the way to the exercise yard one day in Saughton one of them thought they would outdo the rest, up the tempo and clip my heels deliberately, sending me forward at speed, as I turned round to see who,had done this as I had nearly fallen. When my back was to them again one of them muttered ” Hit one of us, we’ll f*ckin show you” and I turned back round and ended up in a minor push / pull skirmish with one of them.
For my troubles I was dived on, one held my head down and had his other hand on my windpipe while the others grabbed my arms.
There was CCTV there in that unit, but they of course knew all the angles and the one doing the choking had his back the camera on the far side.
So any one watching would not have seen the stranglers hand or what he was doing with my windpipe and the other staff side by side and behind me were shielding from the camera at the opposite side of the section.
I tried to say “I couldn’t breathe” and was told ” you’re lucky to be alive ye c*nt”. I was then dragged to a cell up to the opposite end from the one I was located in..
I was stripped naked in a hail of blows and kicks , booted in the testicles and backside , stood on and had my head smashed off the concrete floor several times, all whilst one of these degenerate lowlifes in fancy dress wrapped a stinking towel round my neck and began choking me out.
When I heard about this incident with young Allan my heart went out to his family as they were tellling me they ” were going to f@*king murder me” and kept asking “did I think I was a ‘glesgae’, a weegie and a West Coast gangster? ” to them (the gang on one guy alone, myself) I was a “liberty taker” “who apparently snaked one of them” the deluded little tyrants in dramatic theatrical exaggerated tones they continued their sneers and jeers while they beat down on me.
They knocked me out as I couldn’t breathe with the towel treatment, and when I came to.. my throat was sore, wrists and arms were aching and I was covered in urine and blood. I tried to do the toilet and it was agony and I ended up in a bad way passing blood from urine. Not once wss I seen to by anyone, except the goons who came to ogle and laugh through the spy hole on the cell door.
I still do not know to this day if it was my own urine or theirs. I would not put anything passed them, these people lack accountability so are capable of anything.
They are a ‘gang’ who hunt in packs and gloat in this type of behaviour. At least we know who we are, a lot of these people signed up to carryout personal vendettas once they see how quick management are to cover up their atrocities, you see an almost over confident, smarmy attitude .
They are an absolute bloody disgrace to what they claim to be to say the least . (Lead by example, professional, courteous and treat those in their care with respect and dignity)
I thought I was going to die on that floor in Edinburgh and cant imagine how Allan felt. They absolutely hated anyone from the West coast through there.thats for sure. They kept saying they had f*cked me for life and they had done a number on me with the police and were going to make sure the police would set me up and yadda yadda yadda and more yadda… maybe in their minds as some form of wierd payback for standing upto their bullying and seeing through their evil ways.
I was ‘dug out’ by them because I saw through them and seen what they were really involved in behind those walls.
Tyrants hiding behind an organisation to commit the worst atrocities. That’s facts and they don’t like facts or their true colours being shown. They operate in a shroud of deception and secrecy and keep everything ‘in house’ but why? If they are not doing anything wrong and are the ‘upstanding pillars of the community’ they claim to be?
Every last one at management and supervisor level in every institution throughout Scotland require to be investigated and a proper, true
independent department outwith Govt need to be brought into carry out the investigation as these people chairing inquiries are terrified of becoming victims to this gang so won’t go against, or overrule them. The SPS (Governors, Psychology Dept) and Crown (AD, Fiscals AND lawyers are all the same machine and won’t go against each other). You have to start at top level, the boots on the ground/street only do what their superiors tell them to, and only know what they let them know.
The Allan Marshall case was a farce and a whitewash. Again my heart goes out to Sharon and family. I just hope one day you get closure on this. You have my utmost respect for fighting this evil as I myself know only too well the level of high end corruption you face I’m your battle for justice.

Thank you shuggy we need more people like u to speak up .They can’t keep getting away with this brutality it has to stop the only way I will stop campaigning is when Allan gets justice
